The All Progressives Congress (APC) has reportedly withdrawn its petition challenging the reelection of Osun State Governor, Ademola Adeleke, barely 24 hours after the suit was displayed by the State Governorship Election Petition Tribunal.
The withdrawal came amid conflicting positions within the party’s legal team over whether the APC had authorised the petition challenging the outcome of the August 15 governorship election.
The APC petition, numbered EPT/OS/GOV/01/2026, was filed alongside another petition by the Peoples Democratic Party, PDP, numbered EPT/OS/GOV/02/2026, both of which were submitted at the tribunal on Saturday.
According to The Nation, the APC suit was filed by the party’s counsel, Barrister Oluseyi Oyagbile, who submitted the petition at the tribunal in the company of the party’s Deputy Governorship Candidate, Engineer Kayode Adereti, and other party leaders.
Adereti reportedly signed the petition on behalf of the APC governorship candidate, Asiwaju Munirudeen Bola Oyebamiji.

However, an APC legal team led by Abiodun Layonu, SAN, had earlier disowned the petition, insisting that the party and its candidate had decided not to challenge Adeleke’s victory at the tribunal.
Oyagbile, who confirmed the withdrawal of the petition to The Nation on Tuesday, said he acted on instructions from his client and APC leaders.
“My client and leaders of APC reached out to me this morning to withdraw the petition I filed on their behalf, I have withdrawn the petition,” he said.
The lawyer explained that he sought written confirmation of the instruction before withdrawing the case to prevent further controversy.
“Before I do so, I made them send WhatsApp messages to me giving the instruction so that it will not be a matter of controversy again,” Oyagbile added.
He maintained that the petition had been validly filed after Adereti signed it at the tribunal in the presence of other APC leaders and executives on Saturday.
Oyagbile reiterated that the Deputy Governorship Candidate participated in the filing process, insisting that the petition was submitted with the involvement of party leaders.
